Before your upcoming appointment, your healthcare provider (“Healthcare Provider”) asks that you complete this short IntakeAid questionnaire and chat with our animated health assistant about your treatment needs. This is a great opportunity for you to describe the health issues you are experiencing and help your provider prepare for your appointment.

Please note: IntakeAid is not for emergencies. If you're experiencing a medical or mental health emergency, call 911 or go to the nearest ER.

1. USING OUR SERVICES

By using IntakeAid’s services, you agree to these Terms of Use which govern your use of IntakeAid’s platform, website, apps, Artificial Intelligence (AI)) technology, and related services (collectively, the "Services"). You confirm that you are at least 18 years old, you have read and agree to these Terms, and that your use of the platform is voluntary. If you do not agree, please do not use the Services and exit this questionnaire.

2. YOUR PRIVACY

We take your privacy seriously and use reasonable safeguards to protect your data. By using IntakeAid, you consent to our collection and use of your personal and health-related information as described in our [Privacy Policy].

3. NOT MEDICAL ADVICE

IntakeAid strongly respects and affirms your Healthcare Provider’s authority, responsibility, and accountability for determining the best information and course of action to be used in the diagnosis and treatment of their patients. IntakeAid is a clinical decision support (CDS) tool that is intended to support, not replace, the independent medical judgment of licensed Healthcare Providers in their care of patients. IntakeAid’s AI generated reports are provided “as is” for informational purposes only and are not approved by IntakeAid. IntakeAid is not intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease, it is not intended for use as a diagnostic or therapeutic device, and it does not offer definitive medical advice. We cannot guarantee your Healthcare Provider will review your report(s), and we cannot control how your Healthcare Provider may use your report(s), including their distribution to other healthcare personnel. You remain obligated to attend your Healthcare Provider appointment as scheduled, and to discuss your healthcare needs with your provider at that time.

By using IntakeAid, you acknowledge and agree that no doctor-patient relationship exists between you and IntakeAid, and the information you are providing is being collected by an AI agent, not a medical professional. By using these Services, you agree that IntakeAid is not responsible for any actions, inactions, errors or delays of your Healthcare Provider(s), including any injuries or harm caused by delayed or inappropriate care.

4. YOUR RESPONSIBILITIES

By using the Services, you agree to provide accurate information, to only use our platform as intended, and that you may not copy, modify, or distribute our content or code. You agree not to share IntakeAid’s interview links or your account credentials with anyone except as authorized and directed by IntakeAid, your Healthcare Provider, and/or provider practice.

5. THIRT-PARTY SERVICES

IntakeAid does not endorse, recommend, or refer you to third-party services.

6. NO GUARANTEES

The Services and all related content are provided “as is,” without any warranties. IntakeAid makes no promises—express or implied—about the accuracy, reliability, validity, or performance of the Services, including fitness for a particular purpose, merchantability, or non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, always available, or fully secure. Service performance may be affected by factors beyond our control, including but not limited to viruses, worms, Trojan horses, malware, malicious third-party activity, power outages, hardware failures, or issues with internet connectivity or access.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by law, you agree that IntakeAid’s total liability for any direct damages arising out of or relating to your use of the Services shall not exceed one hundred dollars ($100). Under no circumstances shall IntakeAid be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages—including but not limited to loss of data, personal injury, wrongful death, emotional distress, loss of goodwill, or lost opportunities—arising out of or in connection with your access to or use of the Services, even if not advised of the possibility of such damages. This limitation applies regardless of the venue or the legal theory, whether in contract, tort (including negligence), strict liability, or otherwise.

8. OWNERSHIP

IntakeAid owns all rights, title, and interest in and to the Services. You do not acquire any ownership, license, or other intellectual property rights in IntakeAid by your use of the Services, including any software, code, algorithms, models, user interfaces, system architecture, derivative works, trade dress, or branding. You agree not to reproduce, distribute, modify, create derivative works from, or otherwise exploit any part of the Services without prior written consent. You hereby agree to hold IntakeAid’s proprietary information and trade secrets in strict confidence and not to disclose them or make them available to any person or third party without IntakeAid’s prior written authorization.

9 AI-GENERATED CONTENT

The Services may include content created or modified by AI, including text, images, audio, and data ("Content"). All Content is provided "as is". IntakeAid makes no guarantees regarding the accuracy, quality, validity, or reliability of this Content. You acknowledge that AI-generated Content may have errors, may be inaccurate, incomplete, and may be presented in a way that appears plausible or authoritative. You agree that any consideration or use of this information by your Healthcare Provider is solely at their discretion and subject to their independent professional medical judgment. We may change AI vendors to maintain service quality.

10. EVENTS BEYOND OUR CONTROL

IntakeAid is not responsible for delays or failure to perform due to events beyond our control such as natural disasters, war, network issues, or service disruptions.

11. DATA RETENTION

We only keep your data as long as needed to provide the Services or as required by law. You can request deletion of your data at any time.

12. COMMUNICATIONS

By using IntakeAid, you agree to receive intake-related emails and messages. We do not send unrelated marketing or promotions.

13. ASSIGNMENT

You may not assign or transfer any rights or obligations under these Terms. We may assign our assets, rights, or obligations under these Terms to any affiliate, subsidiary, or successor in interest of IntakeAid.

14. GOVERNING LAW

These Terms are governed by the laws of Delaware. If a dispute arises between you and your Healthcare Provider, you agree that IntakeAid has no obligation to intervene, and you release IntakeAid from any and all claims, demands, and damages of every kind and nature arising out of or related to such disputes or to your use of the Services. Any disputes between you and IntakeAid under these Terms will be brought exclusively in the Delaware Superior Court located in New Castle County, Delaware.

15. ENTIRE AGREEMENT

These Terms of Use, along with our Privacy Policy, constitute the entire agreement between you and IntakeAid regarding your use of the Services, superseding any prior agreements or communications.

By using IntakeAid’s Services, you agree to these Terms and acknowledge that you have read and understand our Privacy Policy. If you do not agree, please exit the platform.
